After almost two years of trying to get the Board to follow the law, our bylaws and our Master Declaration, I ran out of options and had to turn to the New Jersey Court system.

 

I am NOT suing for money and in fact it has cost me almost $2,000 already in filing fees, copying fees, mailing fees, and service fees.

 

I have NOT paid anyone to help me write my documents as Flo Fortuna has claimed. NO ONE is helping me.

 

Here is what I am suing for:

 

1) To try and make the Board adhere to the Capital Reserve Funding law where they have to follow the spending plan they make so that we do not have to take a loan if we run out of money.

 

2) To remove the Cease and Desist against me that was based on a false allegation by Juan Acevedo that I harassed him. The video, which the McGovern law firm based the Cease and Desist on, showed me talking on the phone, and Juan walked by me a few times. I did not follow him, I did not talk to him, and I certainly did not harass him. I filed a complaint with the Judiciary, and they said they did not have jurisdiction over Juan or Michael, so if I am fined, they cannot remove the fine. Therefore, I had to go to the NJ court.

 

3) To have the Resolution which allows the Board to destroy documents to be overturned and to remove the requirement that we have to sign an affidavit stating we will be responsible for any consequences which occur as a result of us sharing them, which includes talking about them at Board Meetings.

 

4) To prevent Tom Gialanella (signed the First Service Contract), Dan Pagano (responsible for the wrong financial statements), Sal Pirrera, and Michael Alejandro, who have brought in their vendors, which have at least doubled our cost from putting us in the position of having to take a loan. Our inaccurate financial statements which one month even included a negative bank balance will prevent us from getting a loan from anyone BUT FirstService.

 

5) I am trying to get a fair voting system. For the last two years, the Board, with the help of Managment, have interfered in our elections.
